1. Agreement to Terms

By accessing and using Kamloops AI Chatbots ("the Service"), operated by Kamloops AI Chatbots ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms constitute a legally binding agreement between you and Kamloops AI Chatbots.

2. Description of Service

Kamloops AI Chatbots provides AI-powered chatbot services for businesses, including:

• Custom AI chatbot creation and configuration
• Message processing and response generation
• Lead capture and email notification services
• Analytics and usage tracking
• Customer support and technical assistance

Our service uses artificial intelligence technology, including OpenAI's language models, to generate responses.

3. User Accounts and Registration

To use our Service, you must:

• Be at least 18 years of age or have parental consent
• Provide accurate, current, and complete information
• Maintain and update your account information
• Safeguard your account credentials
• Accept responsibility for activities under your account

You may not share your account credentials with others or allow unauthorized access to your account.

4. Fees and Payment Terms

4.1 Setup Fee

A one-time setup fee of $349 CAD is required for chatbot creation and configuration. This fee is non-refundable once work has commenced on your chatbot.

4.2 Subscription Plans

Monthly subscription plans are available as follows:

• Starter Plan: $99/month - Up to 500 messages
• Growth Plan: $199/month - Up to 2,000 messages
• Pro Plan: $499/month - Up to 10,000 messages

4.3 Payment Processing

All payments are processed through Stripe. You agree to provide accurate payment information and authorize us to charge your payment method for subscription fees.

4.4 Billing Cycle

Subscription fees are billed monthly in advance. Your subscription will automatically renew unless cancelled at least 24 hours before the renewal date.

4.5 Overages

If you exceed your monthly message limit, additional messages will be billed at $0.10 per message or your chatbot may be temporarily suspended until the next billing cycle.

5. Cancellation and Refunds

5.1 Setup Fee

The one-time setup fee is non-refundable once chatbot configuration has begun.

5.2 Subscription Cancellation

You may cancel your subscription at any time through your dashboard or by contacting customer support. Cancellation takes effect at the end of the current billing period.

5.3 Pro-Rated Refunds

No pro-rated refunds are provided for partial months of service. You will continue to have access to the Service until the end of your current billing period.

6. AI Service Limitations and Disclaimers

6.1 AI Accuracy

Our AI chatbots use advanced language models but may occasionally provide inaccurate, incomplete, or inappropriate responses. You are responsible for reviewing and monitoring chatbot interactions.

6.2 Human Oversight

We recommend regular review of chatbot conversations and responses. You should implement human oversight for critical customer interactions.

6.3 Service Availability

While we strive for 99.9% uptime, we cannot guarantee uninterrupted service. The Service may be temporarily unavailable for maintenance, updates, or technical issues.

7. User Responsibilities and Conduct

As a user of our Service, you agree to:

• Use the Service for lawful business purposes only
• Not provide false, misleading, or harmful information
• Not attempt to circumvent message limits or technical restrictions
• Not use the Service for illegal activities or content
• Comply with all applicable laws and regulations
• Not interfere with or disrupt the Service
• Not attempt to gain unauthorized access to our systems

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including all software, code, designs, and content, is owned by Kamloops AI Chatbots and protected by copyright, trademark, and other intellectual property laws.

8.2 Your Business Information

You retain ownership of your business information, chatbot configurations, and customer data. You grant us a license to use this information solely to provide the Service to you.

8.3 Generated Content

AI-generated responses are provided for your use. You are responsible for ensuring compliance with applicable laws and regulations regarding the use of such content.

9. Privacy and Data Protection

Our collection, use, and disclosure of your information is governed by our Privacy Policy, which is incorporated by reference into these Terms. We comply with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

10. Limitation of Liability

10.1 Service Disclaimer

The Service is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Damages Limitation

To the maximum extent permitted by law, Kamloops AI Chatbots shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

10.3 Maximum Liability

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid for the Service in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Kamloops AI Chatbots and our officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your business activities and customer interactions

12. Termination

12.1 Termination by You

You may terminate your account at any time by cancelling your subscription. Upon termination, you will lose access to the Service at the end of your current billing period.

12.2 Termination by Us

We may terminate or suspend your account immediately for:

• Breach of these Terms
• Violation of applicable laws
• Fraudulent or harmful activities
• Non-payment of fees

12.3 Effect of Termination

Upon termination, you will remain liable for all fees incurred prior to termination. We may delete your account data after 30 days.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or provincial courts located in British Columbia.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

Material changes will be communicated via email to registered users at least 30 days prior to implementation.
